1. ACCEPTANCE OF TERMS
By downloading, installing, accessing, or using the BabyAI mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
2. DESCRIPTION OF SERVICE
BabyAI is a mobile application that provides:
- Baby profile management
- Sleep and feeding tracking
- AI-powered parenting guidance
- Pattern insights and analytics
The App is designed for parents and guardians to track and manage information about babies aged 0-24 months.
3. ELIGIBILITY
You must be at least 18 years old to use this App. By using the App, you represent and warrant that:
- You are at least 18 years of age
- You have the legal capacity to enter into these Terms
- You will use the App in accordance with all applicable laws and regulations
4. PURCHASE AND PAYMENT
4.1 Subscription Plans
BabyAI offers auto-renewable subscription plans that provide access to premium features. Subscription pricing and plans are displayed within the App and may vary by region and platform (Apple App Store or Google Play Store).
4.2 Auto-Renewable Subscriptions
By subscribing to BabyAI, you agree to the following:
- Your subscription will automatically renew at the end of each subscription period unless you cancel at least 24 hours before the end of the current period
- Payment will be charged to your Apple ID account (iOS) or Google Play account (Android) at confirmation of purchase
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscriptions by going to your account settings on the App Store (iOS) or Google Play Store (Android) after purchase
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription
4.3 Payment
Payment is processed through the Apple App Store or Google Play Store in accordance with their respective terms and conditions. All prices are displayed in your local currency as determined by the App Store or Google Play Store.
4.4 Subscription Cancellation
You may cancel your subscription at any time through your device's App Store or Google Play Store account settings. Cancellation will take effect at the end of the current subscription period, and you will continue to have access to premium features until the end of that period.
4.5 Refunds
Refund requests are subject to the refund policies of the Apple App Store or Google Play Store. We do not process refunds directly. For subscription refunds, please contact Apple Support (iOS) or Google Play Support (Android).
5. MEDICAL DISCLAIMER
5.1 Not Medical Advice
The information, guidance, and AI-generated responses provided by BabyAI are for informational and educational purposes only. They are NOT intended to be a substitute for professional medical advice, diagnosis, or treatment.
5.2 Always Seek Medical Advice
Always seek the advice of your physician, pediatrician, or other qualified health provider with any questions you may have regarding your baby's health, medical condition, or care. Never disregard professional medical advice or delay in seeking it because of something you have read or received through the App.
5.3 Emergency Situations
In case of a medical emergency, contact your local emergency services immediately. Do not rely on the App for emergency medical situations.
5.4 No Medical Relationship
Use of the App does not create a doctor-patient, therapist-patient, or any other professional relationship between you and us or any third party.
6. USER RESPONSIBILITIES
6.1 Accurate Information
You are responsible for providing accurate information when using the App. We are not responsible for any consequences resulting from inaccurate or incomplete data entry.
6.2 Appropriate Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that violates any applicable law or regulation
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App or servers connected to the App
- Use the App to transmit any malicious code or harmful content
6.3 Device Security
You are responsible for maintaining the security of your device and protecting your data. We are not responsible for any loss of data due to device loss, theft, or unauthorized access.
7. AI FEATURES
7.1 AI-Generated Content
The AI chat feature uses third-party AI services (OpenAI) to generate responses. We do not guarantee the accuracy, completeness, or usefulness of AI-generated content.
7.2 Internet Connection Required
The AI chat feature requires an active internet connection. We are not responsible for service interruptions or connectivity issues.
7.3 AI Service Limitations
AI responses are generated based on general knowledge and patterns. They may not be applicable to your specific situation. Always use your judgment and consult healthcare professionals when needed.
8. INTELLECTUAL PROPERTY
8.1 Our Rights
The App, including its design, features, functionality, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws.
8.2 Your Rights
You are granted a limited, non-exclusive, non-transferable license to use the App on your personal device for your personal, non-commercial use.

11. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF INFORMATION
We do not warrant that:
- The App will meet your requirements
- The App will be uninterrupted, timely, secure, or error-free
- The results obtained from using the App will be accurate or reliable
- Any errors in the App will be corrected
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP
- DAMAGES RESULTING FROM ANY CONDUCT OR CONTENT OF THIRD PARTIES
- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR USE OF YOUR DATA
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Any content you submit or transmit through the App
14. TERMINATION
14.1 Your Right to Terminate
You may stop using the App at any time by deleting it from your device.
14.2 Our Right to Terminate
We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, for any reason, including if you breach these Terms.
14.3 Effect of Termination
Upon termination, your right to use the App will immediately cease. All data stored locally on your device will remain until you delete the App or clear its data.
15. CHANGES TO TERMS
We reserve the right to modify these Terms at any time. We will notify you of any material changes by:
- Posting the updated Terms in the App
- Updating the "Last Updated" date
Your continued use of the App after such changes constitutes your acceptance of the new Terms.
16. GOVERNING LAW
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
17. DISPUTE RESOLUTION
Any disputes arising out of or relating to these Terms or the App shall be resolved through good faith negotiations or through appropriate legal channels.
18. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
19. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements and understandings.
20. WAIVER
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
